The government’s Domestic Abuse Bill, which will provide new protection for victims of abuse, has received the Royal Assent and is therefore now an Act of Parliament.
Legal abuse will be given a legal definition for the first time in history which identifies a wide range of abuses beyond the act of physical violence, which will include emotional, coercive or controlling behaviour, and economic abuse.
This new law has been long awaited and will work to provide important protections and support for victims ensuring that abusers will no longer be allowed to directly cross-examine their victims in the family and civil courts. The Act will also give victims a greater protection at court to help prevent intimidation which will include giving evidence via video link or from behind a protective screen.
The Act will provide additional protection by providing the police with additional powers. The police can issue Domestic Abuse Protection Notices and the courts will have new powers to force perpetrators to address their behaviour with powers relating to Mental Health support and alcohol and drug rehabilitation. The Act also specifically extends the offence of controlling or coercive behaviour, relating to Children.
Speaking on the new law Home Secretary Priti Patel said:
“The Domestic Abuse Act is long overdue. This landmark act will transform the support we offer across society. This includes the support Government provides to victims to ensure they have the protection they rightly need, so that perpetrators of these abhorrent crimes are brought to justice.”
